General Terms and Conditions of Business
For orders placed via the online shop of FOGGENBERGER GMBH (FOGGI’S HUNDELECKERLI),the following General Terms and Conditions of Business (GT&Cs) as they appear at the time of the respective order shall apply. We do not accept terms and conditions of the customer that conflict with or deviate from our Terms and Conditions of Business.
By submitting an order in the online shop, the customer makes a binding offer concerning the goods contained in the shopping basket. Upon placing an order, the customer expressly accepts these General Terms and Conditions of Business.
After having submitted an order, the customer will receive a confirmation email from the vendor. This acknowledgement of receipt will not constitute acceptance of your offer, but only serves to inform you that the vendor has received your order. A contract will only be created once the goods you ordered are dispatched.
FOGGENBERGER GMBH reserves the right not to accept an order in the event of typing errors or price quoting errors. The vendor will act likewise if there are any doubts about the ability to pay. Silence shall not be deemed to constitute acceptance of the offer.
If the customer orders goods for shipment to third parties, only the customer, not the third party, will be our contractual partner.
The prices valid at the time when the order is placed shall apply. All prices we quote include value-added tax at the statutory rate (currently 13%) and exclude shipping charges. All prices are exclusively calculated in euros.
For orders with an order value of € 50 or more, we ship our goods free of shipping charges within Austria. If the order value is below € 50, we charge a flat-rate shipping fee of € 6.
If the purchase value of an order is € 70 or higher, we deliver to Germany and Slovenia free of shipping charges. If the order value is below € 70, we charge a flat-rate shipping fee of € 10.
We ship frozen meat exclusively to private customers within Austria. The minimum order quantity amounts to 10 kg (below this, the meat would no longer arrive frozen).
For every 25kg unit of frozen meat (insulated box holding 25 kg),we charge a shipping fee of € 8.
Example: The shipping charges for 26 kg of frozen goods would amount to €16.
Frozen meat is shipped in an insulated box. This box is reused by Foggenberger GMBH. Therefore, the recipient must return the insulated box to Foggenberger GMBH within 14 days of the invoice date. A return label is enclosed with the delivery. The return parcel must be deposited by Foggenberger GMBH’s customer with the postal delivery company personally or with a postal shop.
If the parcel is not returned to Foggenberger GMBH within 14 days of the invoice date, the customer will be charged € 50 for the insulated box.
Frozen meat is delivered by post. These deliveries are so-called “next day” deliveries = express deliveries. With this delivery option, the postal service delivers within 48 hours !!! (following handover of the goods by Foggenberger to the postal delivery company). If the recipient is not personally present to accept the delivery, the box is deposited at the recipient’s premises – even WITHOUT signature release authorisation. After the postal delivery company has deposited the parcel, Foggenberger GMBH no longer accepts any kind of liability for the goods delivered!
The insulated box should ensure that the cold chain (< 7°C) is maintained over a period of at least 48 hours. If the goods nevertheless defrost/thaw, this does not constitute a loss of quality as long as the goods are still cool. The goods can be immediately refrozen again or used as animal food. Foggenberger GmbH accepts no liability in such cases.
In the case of temperatures above 25°C, Foggenberger GMBH can no longer guarantee that the goods will arrive frozen at the recipient’s premises.
A complaint may be made if the freezer box is not delivered within 48 hours (following handover to the postal delivery company). In this case, the customer may refuse to accept the box or may return the full box directly to Foggenberger. We shall then take care of disposing of the spoiled goods.
If this should happen, please personally contact Foggenberger so that a complaint concerning the delivery can be made to the postal service.

Foggenberger does not deliver frozen goods to resellers by post or using a forwarder!!! Such goods have to be collected by the reseller on site (8141 Premstätten),subject to prior agreement.
The goods delivered will remain the vendor’s property until they have been fully paid.
Complaints must be made within 14 days of the invoice date.

The customer’s warranty rights are based on the general statutory provisions.
The contractual relationship between the vendor and the customer shall be governed by the laws of the Republic of Austria (payable and actionable in Graz).

ADVANCE PAYMENT: Payment is made in advance (direct bank transfer). The goods will not be dispatched until the amount payable has been credited to Foggenberger’s bank account.
